Crimes without criminals

A legal paper on the impact of Article 60 of the Penal Code on impunity for crimes of domestic violence against women.
The paper deals with a legal analysis of Article 60 of the Egyptian Penal Code, which states: “The provisions of the Penal Code do not apply to every act committed with good intent in pursuance of a right established by Sharia.” This article allows offenses to be considered assault
Simple acts on women within the family (permissible acts), and thus help the perpetrators to escape punishment in domestic violence crimes that affect women.
The paper analyzes a number of judicial rulings of the Court of Cassation related to Article 60 and its use in cases of assault on women. At the end of the paper, the paper makes two recommendations:
The first relates to replacing the existing text
Article with a more disciplined text.
It does not include what is known as the right to discipline as a permissible act.
The paper also recommends introducing new articles in the Penal Code, or issuing a special law that defines all forms of violence against women and sets deterrent penalties for them.
